Event Recap: ABA Fall Meeting

The 2024 Fall Meeting of the American Bar Association, Forum on Construction Law, themed "The Built Environment: Drawing on Design," explored the roles of design professionals, owners, and constructors in construction projects. The event covered topics such as design standards, professional liability, design-build delivery, and the impact of AI and BIM.

In a session titled “AI in Construction: Navigating Legal & Ethical Terrain,” Pasha Ameli, a Managing Director in the Construction Dispute and Advisory practice, and Niloy Ray, Partner at Littler Mendelson, P.C., discussed the transformative impact of artificial intelligence (AI) on the construction industry. 

The presentation focused on AI's potential to address challenges such as labor shortages, rising costs, and project delays, while emphasizing the rapid increase in AI adoption within the sector. Despite its benefits, AI integration introduces complex legal and regulatory challenges, as illustrated by recent legislative actions like the Colorado AI Act and the EU AI Act. These developments necessitate that construction industry stakeholders, including contractors and legal professionals, develop robust compliance strategies to navigate the evolving legal landscape. 

The presentation aimed to guide industry leaders through AI's potential and the regulatory frameworks governing its use, emphasizing the importance of establishing AI governance frameworks to mitigate risks while leveraging AI's transformative potential.
